How to break up Sponsorship Agreement – story by Yana Skybin

Under YMCA’s roof and full support, “settlement counselor” Yana Skybin orchestrated isolation of old parents from the family, manipulated them to break up the Sponsorship Agreement and to illegally obtain social housing on high priority basis i.e. avoiding multiple years waiting list. Skybin tried to take old people’s finances and life under her full control, but got scared away by the law suit. As a damage control, she dag up a dirty lawyer with flipped multiple times personality, who gratefully took advantage of two vulnerable people and secured his salary for 5 years.

Skybin with her friends used to do it before: gaining trust of sick old people who have significant assets with an obvious purpose. Surprisingly, Justice Mulligan was not interested in her motivation. His job was by all means to get YMCA off-hook from this stinky case.

This page is not final and will be updated with chronological links to documents and testimonies which surfaced at the Trial and Discovery. The electronic “log” was produced by Yana Skybin during the procedure of Discovery, but paper notes she admitted to keep before the electronic log starts and after it ends, were destroyed, probably by the advise of her lawyer, and never were provided, despite of multiple requests by plaintiffs. But even without those notes everyone who saw this “log” is, and should be, in shock from the extent of Skybin’s involvement with Nikityuks.

I received a call from Svetlana Danilova telling me that if her parents come to me asking for help with subsidized housing, she wants me to know that nothing changed in their household. They are under influence. Going to YMCA and talking to other people filled their heads with ideas. They are strange and unreasonable. Svetlana and her husband built this house for 4 people, and they are not going to make any changes.

Alla and Valentin came to see me in the office. They asked for information about subsidized housing as they need to separate from their daughter and son-in-law. I explained the sponsorship requirements, and the wait list for subsidized housing. They said the atmosphere at home is unbearable. The daughter yells at them, and attacked Alla. She showed me her bruises. The son-in-law yelled at them, too, and threw plates at them that ended up making holes in the wall in the living room. There were signs of distress and fear in their eyes and voices. Alla started to cry. She said the daughter is telling her she is crazy and depressed. Alla and Valentin spoke up when their granddaughter visited last time. The granddaughter was shocked to discover what was going on in the family. She spoke with the parents and told Alla and Valentin things will improve, begging them to give it a try. I gave them a handout about elder abuse and explained that they do not have to remain silent. They can ask for help when they are ready. They asked not to tell anyone. They’ll give it a try. After granddaughter’s visit, the daughter started making an effort, and they were willing to go along.

Funny story. On August 20 Nikityuks attend birthday party, everybody’s happy, nobody mentions any “abuse”, Alla wears short sleeves but no one sees any “bruises”. Nikityuks brought an expensive gift. What was the gift is a mystery even after all oral examinations, trial etc. Look at the transcripts in “Gratitude” or bribery? But the important fact is that 2 days after that mysterious precious gift Nikityuks start the process of obtaining social housing on high priority basis.

Later the same weekend of August 20 with granddaughter “shocked to see bruises” was mentioned in YMCA’s letter which widely circulated in different organizations from Ontario Works to Ministry of Citizenship and Immigration. Mr. Mae submits that it was “Yana’s honest mistake”. Off course it was. The mistake was that on September 30, when she actually started to write her “log” “from her memories”, Yana forgot that weekend she was referring too was her birthday party, and the fact that she did not see any bruises back then can actually be proven!

This is what in fact happened during that weekend when “their granddaughter visited last time”, and that famous libel letter is attached to Anastasia’s affidavit:

I got a call from the daughter at another time, telling me how grateful she is that there is such a person like me that they can always call and receive the support. She is happy she has someone to rely on when she needs support. I did not tell her about her parents’ visit, just listened and said “anytime.”

Alla and Valentin came back to my office, saying things have gone worse, and peace did not last. The abuse is ongoing and they can’t live like that. They are now hiding in their rooms and come out only when the daughter and son-in-law are not around. The daughter yells at the mother, and Valentin. She blocks bathroom door to prevent mother from hiding there to avoid her verbal attacks. She constantly threatens to take away the car keys.

They showed me a list of deductions from their pension the daughter and son-in-law made for computer use, TV, food, gas and other things for when Valentin’s daughter visited. Svetlana warned them that there is just enough food in the fridge and if they need anything else, they should buy it themselves.

Valentin and Alla asked to open a bank account in their own name, so that they could redirect their pension there. The daughter had full control of their finances including pension. They received appr. $1,800 in September. She gave them a PC card, and said they can deduct $200. When they did, the balance was $300. The rest of their pension the daughter and son-in-law withheld to cover the expenses they considered made on behalf of the parents.

Made a plan to go to Scotiabank to open a bank account.

One month after the alleged incidents with bruises and thrown plates, how much worse “things can get”, seriously? Isn’t it a time to take a least some pictures of those “things” which are apparently “worse than bruises and thrown plates”?

Let’s see: daughter “blocks bathroom door”? What a ridiculous accusation, Erik Bornmann just loves them. Come on, there are 3.5 bathrooms in the house – can “mother” just go to another one, if this one is occupied by her daughter?

Deductions from pension? So what?? Millions of people spend their pension on “computers, TV, food, gas and other things”, especially when their relatives visit. And when there is enough food in the fridge, why Nikityuks cannot go and buy what they want themselves? How is it “worse than bruises”?

Any comment, Your Honor? Well, we come to your “decision” eventually where you quote all this absurd.

Met with Dorothy from Barrie Women’s Shelter and made a housing application. Connected with Community Legal Clinic re revocation of power of attorney. Made an appointment for Oct. 20. Went to TD bank. Got a print out of accounts, financial information.

This is when Nikityuks were “registered” in a shelter. Just registered, but they kept living at home where “things kept getting worse than bruises and thrown plates”. Other people, those who were really abused by someone, or refugees, or other desperate people who cannot afford to make a $50 gift to Yana Skybin, live in shelters for years waiting for an available social housing apartment. These two “abused” got it in 4 days:

Met with Suzanne Cooper at Community Legal Clinic. Started process to update financial information through Equifax and Trans Canada, and revoke power of attorney for property and finances and personal care. Will be a couple of weeks before the info will become available.

Called Bev, she has 2-hour legal aid certificate for consultation. Bev is looking for a Russian speaking civil litigation lawyer. As well Bev is waiting for a confirmation from Legal Aid to apply for legal aid certificate in person on Wed., Oct. 19.

Called Dorothy, asked how A. and V. can view an apartment on Blake St. Dorothy will follow up.

Went to see an apartment at 75 Amelia Street. They need to provide verification of their income. Yana contacted the CLC to request an affidavit that their income is being verified. Dorothy took V. and A. to see furniture. Yana to make a wish list of items needed (with V. and A.)

October 17, 2011

Got a call from A. and V. at night, saying they are outside because of confrontation. Daughter discovered that the couple closed the joint account, and was very mad with them. I called Women’s Shelter and then the Salvation Army and made arrangements for an overnight stay at a motel downtown Barrie. Their friend was able to pick them up. They tried to leave, but the daughter blocked the doorway. V. used the 911 cell phone, but could not speak to the dispatcher. Yet, the family let them go.

They got a new hotel for 7 days, arranged by the Women’s Shelter and provided by the Salvation Army. They viewed the apartment at 1 Blake St. They accepted the offer. Will come to sign lease on Friday, Oct. 21.

Daughter called me and the office and other people looking for them. The couple does not want to see her. They will not come to classes for now.

Yana spoke with Community Legal Clinic. They are working on revocation of power of attorney. Yana spoke to Graham Partners. They are drafting a letter to revoke the power of attorney. The couple got an appointment with Ontario Works.

They are planning to move to the apartment on Monday, Oct. 24. They are getting the help from friends and police and women’s shelter.

The plan is to apply for Legal Aid on Oct. 19th. Kim Clark will see them on Oct. 19th to help with the 911 phone. Barrie Women’s Shelter helped get mail redirected to the new place. They also paid for it. The couple got bus passes and Tim Horton’s coupons from the Women’s Shelter.

On Oct. 19th Yana will take them to No Frills to get some groceries.

Wow! After 3 years of practically full time English classes at YMCA Newcomer Services Nikityuks cannot even shop for groceries without Yana’s help! Such an “independent” couple!

Met with Kim Clark. The phone is programmed wrong. They will get a new phone. Kim walked them through what to say when they call 911. Daughter called from Valentin’s old cell phone. Asked if I saw them. What was their reaction when I asked them to call her? Said, she will go to emergency. Went to police. Made an occurrence that they are safe and do not wish to be contacted by the daughter and son-in-law. Went to lawyer’s office. Made new power of attorney for property and personal care.

Daughter called again. I did not pick up the phone. Spoke with Community Legal Clinic. Anthony advised that he will request Equifax report based on V. and A.’s authorization. Also said this matter might need to be reported to the police by the couple.

October 21, 2011

I came to work and got approached by a client attending our English classes. She was concerned for A. and V. Said the daughter has been calling her and her husband, and threatening. I brought this up with my Supervisor and Director. The Director invited Russian-speaking clients and explained what they should say if the daughter calls again: We have not seen them. Please stop calling us.

I spoke with one client regarding the conversation she had with the daughter. She said, she calls often (in the morning and then at around 4 p.m.). This also matches the frequency of calls to me. She was looking for information and then started threatening her. She told her at least 5 times to stop calling. The Director approached our HR to consider harassment claim. Then was advised it’s a police matter that should be dealt with outside of YMCA.

I met with A. and V. at the Blake St. apartment building. I gave them a copy and translation of the letter from the lawyer re. their power of attorney. They signed the lease that I have translated. They were given a copy, and the keys. They went to see the apartment. Dorothy came from Women’s Shelter. She brought things for them for starters. Dorothy described how Monday move will look like.

After we left, Dorothy called me and asked to clarify their stay at the hotel. It was reserved for 4 days. Dorothy had to go with A. and V. and extend their stay. She did that, even though it took longer as she told me later. We also made a photocopy of the power of attorney that they set aside to give to the daughter and son-in-law on Monday.

I came to see the couple at their apartment – I brought some curtains for them. They told me the story of how the move went. It took a whole day, but they were successful. They stayed at the apartment and returned the key for the hotel room that morning. I received a request from the Legal Clinic to provide their passport and immigration document (ID). Dorothy called and told me how the move went. We agreed to meet with the couple on Thursday, Oct. 27 at Dorothy’s office to go over the options they have with the police or legal action.

Met with Bev and Dorothy at the Women’s Shelter. Bev provided the couple with a list of Russian-speaking lawyers and told them they have a 2-hr Legal Aid certificate for a consultation. Dorothy went over the events of Monday’s move, and how they felt about it. Answered their questions. I interpreted. Dorothy helped fill out Community Start-Up application. Attached the release for Ontario Works and gave it to the couple to submit with other documents. The couple asked about lawyer, mediator and agreements. We made a plan to meet with Dorothy on Oct. 28 at our office to give them more information.

I received a call from Svetlana, but did not respond. Later she called again and left a voicemail, saying I need to call her urgently. She is about to go to the police and maybe if I call, she would not have to do that. She needs the name and contact of the social worker who helped her parents move. I did not call back. I did call Dorothy and informed her of the situation. Dorothy was going to call Svetlana with resources the next morning.

My office informed me that Svetlana has been calling the office, demanding the name of the social worker who helped her parents move. She’s written a letter to YMCA complaining about our services and accusing us of helping her parents by brainwashing them. They are incompetent and should not be trusted. Our organization is ruining Svetlana and her husband’s reputation and financial situation.

Met with Alla, Valentin and Dorothy. Dorothy told about Svetlana finding her and trying to find out A. and V.’s address. We discussed their legal options. Explained how Ontario Works operates. Gave a pharmacy’s address where they can transfer their medication from Innisfil. Ruth also came in and explained privacy of information and non-disclosure of private information. I made and sent photocopies of their passport, PR card and SIN card (for Alla) to Community Legal Clinic to complete request for Equifax report.

Emailed Anthony from Community Legal Clinic. He is requesting Equifax report. Called two lawyers on the list (Legal Aid), and asked Bev to send details of the certificate to both lawyers. Need to write up a story in Russian (for the lawyer). Prepared letter for Revenue Canada: new direct deposit info, new address and telephone #, a copy of power of attorney, authorization and cancellation form of a representative, request of Option C Printout for 2008, 2009, 2010, and request to send a list of benefits entitlement for 2010. Mailed the package by Xpress post.

Should read it like: need to fabricate some story in Russian for the lawyer.

Got a call from Tony, Community Legal Clinic. He is sending Express Post to Equifax with the request for Alla and Valentin. It’ll be available in 10-12 business days.

Bev emailed that she called and spoke to Ernst Ashurov, and faxed him a blank Legal Aid certificate. Called Ernst, he said he does not have the certificate in the office. Emailed Bev, requesting a new certificate with their names faxed to him, and the release to be faxed to YMCA Newcomer Services, so they could sign it and send back to Bev. Valentin wrote up a story, and we faxed it with the documents pertaining money transfer and what the daughter and son-in-law promised and then charged them while they were here to Ernst Ashurov and Victoria Matushenko. Confirmed the receipt with both.

Dr. Mossman called Ruth. Yana faxed a release for Valentin (he signed it in the office). Called the office of Dr. Mossman, asked for her to call Yana back.

Dr. Mossman called and clarified our role in case of A. and V. Confirmed that Yana can be used as an interpreter if they have a medical appointment. For purposes of mental capacity, Barrie Women’s Shelter can arrange for an independent interpreter. She wanted to know if we will help them with information re resources in the community.

November 7, 2011

Called Ernst Ashurov re consultation. He did not receive the Legal Aid Certificate that Bev faxed on Nov. 2 and 3. Called the Women’s Shelter and spoke with Laurel. She called the lawyer and re-faxed the certificate. Yana to follow up on Nov. 8. Called Revenue Canada. They said to call back next week, as it’ll take 10 days to get the information entered into the system.

Pavel called and inquired if we passed the cheque to Alla and Valentin. Susan Green spoke to him, and told him we cannot comment. We did give them the envelope, but in the future we cannot act as mediators.

Apparently it was a support cheque for the period from October 17, when Nikityuks left the house, to November 30 2011. According to this log, Nikityuks received it on November 7th 2011. Later on the Trial Valentin will testify that he received it on December 20th. Skybin suggested not to deposit it for a while because Nikityuks were in the process of defrauding Ontario Works and support income coming from sponsors would essentially make them ineligible for any social assistance. More details on the episode with the 1st support cheque are coming. Episode was brought up and discussed at the Trial, and why Justice Mulligan ignores it remains a mystery.

Called Ontario Works and clarified their requirement re: direct deposit. A. and V. need to bring a direct deposit slip from the bank. Emailed Victor Nikitine re this case. Emailed bounced back. Emailed Roslynne Greenberg re names of Russian-speaking lawyers. Assisted in completing pre-surgery package – anesthesia questionnaire.

Went to the bank, deposited OW cheque. Obtained a direct deposit slip, which as it turned out contained old address and phone number. Yana advised A. and V. to see Svetlana at Scotiabank on Saturday and clarify contact info in the system.

Ordered mattress – should deliver on Saturday.

What mattress? Nikityuks abandoned two perfect new beds with mattresses at the house when they moved out. Well, probably those two mattresses just did not fit into YMCA’s truck, or YMCA’s helpers just did not want to carry heavy stuff. So Nikityuks decided that they better rob some homeless for another mattress, who cares?

E. Ashurov called – will see A. and V. on Nov. 17 at 2 p.m. for consultation. Y. helped A. and V. with the change of address form for OHIP. Spoke with Crystal Hylton – they received the maximum of Community Start-Up, because of pension from Russian, rent will change monthly – no opportunity to pay rent directly to Simcoe Subsidized Housing, they need to provide letter of attendance and request for a bus pass every month before 16th of the month.

So after 3 years of YMCA English classes Valentin was not able even to change the address without “assistance”! What the hell do they teach on that classes?

Attended lawyer’s consultation. Advised to apply for Legal Aid, open a civil litigation claim and request a certificate to freeze the sale of the house pending litigation. Offered options – legal aid, lawyer in Innisfil/Barrie; or Russian-speaking lawyer who would accept %. Her name is Alexandra Abramian 905-918-1180.

Tony called from CLC, saying Equifax arrived with little info. Will send the report by mail. Advised to go to the banks they know they had accounts with, and provide new power of attorney for file. Kim called from Victim Support Services. Inquired about Alla and Valentin. Dorothy advised she can visit them on Friday, Nov. 25.

Called Dorothy – she is coming to pick up leftover things from A. and V. on Wed., Nov. 23 at 8:15 a.m.; and then she is coming for a visit on Fri. Nov. 25 – she is picking up A. and V. from school. A. and V. are going to apply for Legal Aid on Nov. 23 – Yana to pick up A. and V. from school at 2 p.m. Discussed legal options and interpreter for Valentin’s surgery. Called the surgeon and updated the address with RVH.

Attended Legal Aid application at the Courthouse. They applied for a certificate for support from the sponsor and for civil litigation.

November 29, 2011

Called Revenue Canada. They did not have the new information sent by A. and V. on file yet. Advised to call back at the end of December. Assisted with applying for bus tickets through YMCA Newcomer Services. Received some tickets, but won’t be able to get more in the future as YMCA ran out of funding for bus tickets.

A. and V. received letter of assistance suspension from OW. Called OW, and their worker, Crystal Hilton, said she is no longer their worker. The file is on hold. It’s now being investigated. Advised to call that department. Called the investigation unit. Received the call back from Jocelyn, who spoke to Yana and Ruth on speakerphone, and advised that it has to do with them being sponsored. They have a sponsor who is willing to support them. She received a letter from Svetlana and spoke to her. She is willing to support them and is supporting them. Simcoe County cannot interfere with the laws of Canada. Unless there is something from the police or courts indicating sponsorship breakdown, OW has to respect the sponsorship agreement.

So Ontario Works actually investigated and determined that Nikityuks are not eligible for social assistance because they are sponsored. But guess what? This does not stop Skybin! Under YMCA’s roof she feels covered from all possible angles and, as the Sponsorship Agreement becomes an obstacle for the plan, all she needs to do is to break it!

December 5, 2011

Assisted in applying for Christmas Cheer. Pick up – Dec. 22 at 4 p.m.

Went to TD bank downtown Barrie. Spoke with the manager, Mike Grube. Said the credit card was closed. The waterhouse accounts had no money in them. A. and V. requested to close the accounts. Mike called and went through the process of closing the accounts.

There was joint chequing account (between A., V, Svetlana and Pavel) with no money in it, but money flowing through the account on a regular basis. A. and V. asked to request that their names be taken off the accounts. Mike was going to send a letter to Svetlana and Pavel, and will call them, too, to ask for A.’s and V.’s names to be taken off.

A. and V. deposited the cheque the daughter gave them when they were moving out on Oct. 24th (over $200 of what she indicated was the remainder of their pension), and the cheque she sent to YMCA Newcomer Services (around $1,700).

Oops! That support cheque which was sent to Nikityuks through YMCA and given to them on November the 7th, they tried to deposit 1st time on December 5th, one month later! Being so desperate for money, as Skybin puts it, why didn’t they deposit it right away, in November?

Called Subsidized Housing and asked for rent amount based on the new income. Sheila asked for A. and V. to send the new income info to her. Faxed a copy of the cheque for $1,700. Sheila said it’ll stay the same in December ($211), but in Jan. it’ll go up to $385.

Called Legal Aid re. their application. Response: they received legal aid for letter of opinion from a family lawyer. Started looking for a lawyer. Wrote a letter to Ulana Domazar asking for her if she’d take this case, and meet with A. and V.

December 9, 2011

Ulana Domazar called. Discussed the case over the phone. She agreed to meet with A. and V. on Jan. 10 at 10 a.m. at her office. Suggested they appeal the decision of OW, and involve Com. Legal Clinic at this point. Discussed OW review and appeal with Susan and Ruth at the office. Decided to hold a case conference with Dorothy from Barrie Women’s Shelter and Kim Clark.

Assisted Valentin in writing a cheque for their first Bell bill payment and cheque for rent.

So after 3 years of English classes at YMCA Newcomer Services Valentin cannot even write a cheque without YMCA’s assistance! Good job Newcomer Services!

Got a call later from Carol (ext. 1849) from Subsidized Housing, who indicated that she wanted to meet with A. and V. and discuss that they need to go to Immigration and have the terms of their sponsorship reassessed. She said the cheque the daughter gave them had a stop payment note in the system.

Off course Danilovs put a stop payment on that cheque because at that point they knew already that Nikityuks with Skybin’s help defrauded OW for approximately the same amount, and it must be repaid. So the cheque was cancelled and redirected to OW.

She asked to arrange for a meeting with the couple. Yana called A. and V. and communicated the message to them.

December 12, 2011

Yana picked up A. and V. to go to Food bank. They said the cheque did not go through. Asked to go to the bank. Went to the bank after they received their assistance, and printed off the statements. Both cheques from the daughter had stop payment on them. During conversations Yana noticed that Alla is more emotional when she talks about the relationship breakdown with her daughter. It’s been a stressful period for a long time for the couple, but especially for Alla. Facing uncertainty added even more stress to already difficult situation. Yana emailed Mike, the Branch manager of TD bank, and asked for statements on behalf of A. and V. He emailed he would start the process of getting the statements. Could not meet the next day, but would be happy to help.

December 13, 2011

Met at the office (Newcomer Services) with A. and V., Dorothy, Ruth and Kim Clark. Kim brought letter of support and service. She also gave V. a new cell phone that was working properly. Had a phone intake with Community Legal Clinic who agreed to accept A. and V. as their clients. Ruth drafted the letter with the help of Dorothy and by asking A. and V. questions as to the events of the past and present that contributed to the situation. Mike emailed that the daughter closed the TD chequing account. Later A. and V. called and said they discovered V.’s pension arrived, but not Alla’s. Agreed to meet on Wed., Dec. 14th to continue with the Com. Legal Clinic.

December 14, 2011

Had a case conference with Joanna from CLC. Collected data regarding payments, sponsorship breakdown and internal review request. Offered to review the letter once our office has compiled one on behalf of Alla and Valentin. V. said his pension arrived, but Alla’s was deposited in daughter’s account. The Russian pension board said they only received fax for Valentin’s pension. Yana to work on pension with A. and V. with the Russian Board to find out where the pension went. Ruth to complete the letter for OW, and send it to Joanna.

Helped fax a letter to Russian pension board asking to deposit pension to new account. Helped fax letter to Simcoe Social Housing with new financial info. Sent a draft of letter request to the lawyer – asking to reclaim Alla’s pension from daughter.

She is waiting for a form from Ontario Works re. their assistance in November. Faxed letter to Simcoe social housing on behalf of A. and V. informing of the withdrawal from their CIBC account ($2,500).

Got a call from Cresteena. Asked for investment statements. With Alla and V.’s permission scanned and emailed investment statements, income tax return for previous years and joint account statement for TD bank. Cresteena arranged for a meeting with Pavel and Svetlana on Feb. 22 at 4:30 p.m. February 23, 2012 Cresteena called and said they did not come to the appointment. She got a letter from their lawyer, which she will read when she returns to her office in Baxter. I communicated all of this to Valentin over the phone.

Talked to Cresteena. She received a letter from a consultant in Orangeville who advises Alla and Valentin to provide a lease agreement to Svetlana and Pavel so that they would decide what they are going to cover. Cresteena is going to draft a letter which is asking me to review with Alla and Valentin.

Alla and Valentin brought a letter of submission from Simcoe County Social Assistance with background information and documents for Tribunal’s consideration. Yana translated the background information to them. Informed Joanna from the CLC, and Cresteena of the info communicated in the letter of Submission.

Yana talked to Joanna on the phone. Arranged for a face-to-face appointment with Alla and Valentin on March 7. Joanna advised to bring all the documents they have handy, as well as request a report from the Police of incidences. Cresteena wrote back that she sent a letter of response to Svetlana and Pavel’s lawyer and once she receives a response, she’ll arrange to meet Alla and Valentin in person. Yana emailed Rosemary from Simcoe County (LIP), asking to follow up with Carol, Social Housing, re Nikityuk’s rent calculation upon Alla and Valentin’s request. Rosemary emailed back, saying she’ll follow up with Carol and will communicate shortly.

Attended a meeting at Community Legal Clinic between Joanna and Alla and Valentin. Went over the submission package submitted by Ontario Works to the Tribunal. Clarified questions and made a plan to collect additional documents to support Alla and Valentin’s claim.

Emailed Mike Grubbe requesting statements for two TD Visa accounts and Alla’s investment account. Asked for a copy of power of attorney (signed in 2009). Alla and Valentin asked to contact Cresteena and find out if she heard from Svetlana and Pavel’s lawyer. Emailed Cresteena, and she wrote back that there was no response yet. She was going to wait a bit and call the lawyer herself.

Alla and Valentin brought in a letter from the Tribunal with the court date scheduled for October 2012. Yana translated both police reports that A. and V. obtained from Barrie and Innisfil Police. Barrie report was not correct, and Alla and V. emailed to request a meeting with an independent interpreter so they can have it corrected. Yana wrote down for A. and V. what they need to request from CIBC bank – statements for the past 12 months, their bank and account info, and when their access card was issued.

Communication with Joanna from CLC re documentation required for tribunal. Asked Dorothy for letter of witness. Will send my email on Monday, April 16. Asked Mike Grubbe (TD waterhouse downtown Barrie) for additional statements. He responded that he is waiting for them to arrive in mail. Yulia Malysheva brought a letter on April 13, 2012 requested by Joanna re her communication with Svetlana. Faxed the letter to Joanna. Communicated with Alla and Valentin re their meeting with Cresteena on April 13. She is coming to YMCA office to meet with them re further action in communication with Svetlana’s lawyer. Communicated to Alla and Valentin re documentation required for the Tribunal.

This Yulia Malysheva is a very interesting character. In April 2012 Skybin and YMCA were served with Danilov’s plaintiff claim and this is the letter Skybin asked her friend Malysheva to draft just in case. The plan probably was to use it eventually for some kind of blackmail. Please note that there is nothing in that letter about bruises which both Yana and Yulia allegedly saw. Can you believe that Malysheva is complaining about Svetlana’s telephone calls (in fact there was just one call from Svetlana when she was looking for her parents and called literally every “friend” of Nikityuks before filing a missing person report with the Police, all other stuff in that letter is just a lie nobody can ever check), but not a word about bruises she “saw”? Nobody can, except Honorable Justice Mulligan.

Later, at the Trial, Skybin’s lawyer Mr. Mae, when it was proven by Danilovs that “abuse” incident was fabricated by Skybin in conspiracy with Nikityuks, had no choice but to extend the utilization of Malysheva as a witness, and after 5 months of preparations and damage control between spring and fall sittings, finally talked Malysheva to testify that she saw those mysterious bruises. Look here at “Alleged Physical Abuse” post of mine. Being incredibly stupid, Malysheva cannot memorize the “witness” script Yana prepared for her and on the cross happily screws up the entire testimony because dates of the incident don’t match by several months. But our Honorable Justice Mulligan still not impressed and cannot say a word against YMCA. How could he? After the Trial he still must live next to them in Barrie/Orillia and shall keep seeing Graham Partners in almost every court session, how he would look in their eyes?

Translated the letter by S. and P. Danilov sent to OW and copied to A. and V. by registered mail re. support payments for April, May and June. Faxed that letter to Cresteena Fernandes and spoke with C. over the phone. She is in communication with Danilov’s lawyer and also in conversation with Joanna from CLC who is leading the appeal process for OW. Faxed that letter to Joanna. Received a phone call from Mike with information that the package with statements of investment accounts is available at the front desk for pick up. Communicated that to A. and V. They were going to pick it up. Translated the letter from Ontario Drug Plan re. eligibility and approval. Indicated to A. and V. that they can get reimbursement of spent money if they provide original receipts. Translated letter from Legal Aid re. cancellation of the certificate for Ulana’s work on letter of opinion. Emailed Ulana and asked if she’s done the letter and submitted it to the Legal Aid.

Received a voicemail from Ulana that she submitted a letter of opinion on February 2, 2012. She recommended the case for funding. She was not going to do more work on the case unless Legal Aid was funding it. Communicated Ulana’s message to A. and V. Alla and Valentin brought the package that they picked up from TD bank. Faxed the content to Joanna with a letter of explanation attached.

Received voicemail from Joanna re. release for OW (wrong date entered originally). Joanna was going to communicate with Alla and Valentin re. further submission to the Tribunal. Received a package from Svetlana and Pavel Danilovs at my house that they submitted claim in court against Alla, Valentin, myself and YMCA Newcomer Services. Called Susan Green and informed her of the delivery.

Alla and Valentin requested a meeting with Cresteena and Joanna. Communicated regarding possible dates by email. Alla and Valentin brought a letter from Canada Post saying Alla registered for epost. It had Alla’s name and old address in Innisfil on the letter and envelope. Alla and Valentin asked me to call Canada Post and find out information about this account. We spoke with Les and he advised Alla that this account was opened at the same time as a TD account was opened on October 21, 2011. Alla says she did not open any accounts at that time or earlier or later and asked for Les to close the e-post account and confirm it. Les spoke to Alla to establish her identity. When he asked for a security answer, the security question was: “standard wolf-feeding password.” She did not know anything about it and just asked for the e-post to be closed. He closed the account and gave her confirmation number: 103573846. Valentin called and said he received the same kind of letter from e-post about an account in his name.

Alla and Valentin asked to verify dates for Tribunal and representation from CLC. Emailed Joanna with a question. The date of June 5 has been postponed to December 11 due to the need to book an interpreter. Joanna is going to be gone for 2 weeks and all communication will resume after June 15. Erik called from CLC and asked for a contact with the lawyer representing YMCA. He prepared a response on behalf with A. and V., and emailed it to them in Russian. He is meeting with them on Monday for final revision.

First time where this Erik character shows up. Before, if you look at the log, there were 5 or 6 lawyers mentioned, but no one took this stinky case. Erik Bornmann, Lisa Loader‘s long time protegee, who just began to work for Community Legal Clinic as a lawyer, doesn’t take an issue with stinky cases. As a matter of fact, that’s what he does the best. Case of two vulnerable elderlies, who don’t understand English and have no idea what is going on and what kind of advantage is taken of them, is just a golden life-time opportunity for Erik to gain some score and to secure his paid by tax payers salary at least for 5-6 years. Fiduciary duty? That is the thing he will accuse Danilovs in later, to him it doesn’t apply.

Received a phone call from Valentin that someone from ODSP called him and asked for Svetlana’s phone number. He gave it to them. Advised Valentin that it’s not a good idea to give out this info considering he does not understand what the person on the phone is asking and telling him in English.

Called Eric (CLC) and left a voicemail.

Spoke with my Director and afterwards called ODSP, asked to speak to a worker who would be handling Nikityuks’ case. Left a voicemail with Brenda, asking her to call back regarding Nikityuks. Advised the caseworker that this is a sensitive matter and they should speak with us if possible as the clients can’t communicate fully and don’t understand what they are being asked on the phone. The clients are being supported by the Community Legal Clinic.

So, basically, as it is sensitive matter, ODSP should speak to YMCA and not to the relatives? That is what YMCA told Valentin after he gave ODSP his emergency contact!

Received verbal permission from Valentin over the phone to tell ODSP their SIN numbers. Received a call from Brenda 705-727-5633. She clarified A. and V.’s support income. Scheduled an appointment for them for Aug. 22 for 11 a.m. Asked if I can come with them. Talked to S. Green. Got permission to attend this appointment as a support worker.
